The Federal High Court sitting in Abuja has adjourned the arraignment of activist and politician Omoyele Sowore till October 27.
Sowore is facing a five-count charge for allegedly making derogatory remarks about President Bola Ahmed Tinubu on his social media platforms.
At Monday’s proceedings, his lawyer Marshall Abubakar informed the court that Sowore had not been personally served with the charges as required by law.
The prosecution, led by Mohammed Abubakar, explained that while Meta Inc. and another defendant had been served electronically, Sowore was yet to receive his own copy.
The prosecution then applied to serve Sowore in open court. His counsel did not oppose the application. After service was completed, Sowore’s lawyer prayed for three days to study the charges.
The prosecution objected, insisting that since Sowore had been served in court, proceedings should continue.
Court’s Ruling
Justice Mohammed Umar disagreed. He ruled that defendants are entitled to time under the law to review charges before arraignment.
“The defendants are entitled to time to go through the charge,” Justice Umar held. He then fixed October 27 for Sowore’s arraignment.
